Mamata Banerjee Refuses to Concede”: Asserts Stance as High Court Nullifies OBC Certificates

Chief Minister Mamata Banerjee firmly declared her refusal to comply with the directive, emphasizing that it would strip the Tapashili community of their bestowed rights.

The Calcutta High Court has invalidated all Other Backward Classes certificates issued in Bengal since 2011 under the Trinamool Congress administration, deeming them “illegitimate”. Nonetheless, the court clarified that this ruling would not impact individuals currently employed or enrolled in educational institutions, or those who have already submitted applications with caste certificates.

Chief Minister Mamata Banerjee has firmly stated her refusal to acknowledge the directive, emphasizing its potential to strip away the rights bestowed upon the Tapashili community.

The court invalidated reservations for numerous communities categorized as Other Backward Classes under a fresh state government law enacted in 2012.

Justices Tapabrata Chakraborty and Rajasekhar Mantha, however, asserted that the executive orders of the state government delineating 66 categories of OBCs prior to 2010 remained untouched, as they were not contested in the petitions submitted in the case.

“PM Modi’s assertion that Muslims would annul Tapashili reservations was another attempt at division. Today’s court ruling reflects this agenda. While I respect the judiciary, I cannot endorse a verdict excluding Muslims from OBC reservations. OBC quotas, as introduced by the West Bengal government, will persist,” asserted Mamata Banerjee.

“After conducting a comprehensive house-to-house survey, we drafted the Bill, which received approval from both the cabinet and the assembly. The BJP’s attempt to obstruct it failed in court,” she concluded.

Critiquing particular judges of the High Court, the Chief Minister exclaimed, “One judge identifies as ‘an RSS person’, while another aligns with the BJP… How can impartial justice prevail when judges exhibit such affiliations?”
